Statement

When we stand up for judicial independence, we do it because we want to protect the autonomous, impartial, and independent functioning of the judicial system. An independent judicial system, free from any undue influence, is a fundamental right of the citizens. The public threat of listing judges and it’s aim reminds us of the darkest times in history and clearly proves, to outside observers as well, all our concerns regarding the reality of the attacks against the judicial independence and the judges.

We would like to stress that “the judge must not only refrain from any unnecessary contacts and influence with the executive and legislative branches of government, but this must also be apparent to an outside observer, and the judge must develop and maintain safeguards to ensure the organisational and operational independence of the judiciary. Within the framework of the law, the Code of Ethics for Judges and international conventions, the judge has the right to express his or her opinion and even the duty to do so in order to protect the independence of the judiciary.” (The communication of the Presidents of the Disciplinary Service Courts, 9th of December 2024.)
